Terms of Use

Last updated: 04/18/2026

1. Acceptance of Terms

By accessing or using Feriados API, you agree to these Terms of Use. If you do not agree with the terms, do not use the service.

2. Service Description

The service provides national, state, and municipal holiday data for Brazil via API and web dashboard, including authentication, key management, and subscription features.

3. Account, Organizations, and Access

You are responsible for the accuracy of your account information and the security of your access credentials. Accounts may use email/password authentication or supported OAuth providers.

The service allows the creation of organizations with multiple members. The organization owner or administrator is responsible for invited members and their use of the service, including quota consumption, API key management, and compliance with these Terms. The maximum number of members per organization varies according to the contracted plan.

4. License of Use

We grant a limited, non-exclusive, non-transferable, and revocable license to use the service in accordance with the contracted plan and these Terms.

5. Usage Restrictions

You agree not to:

  • Resell, sublicense, or improperly share access
  • Bypass authentication, quota controls, or security mechanisms
  • Use the service for unlawful purposes or in violation of third-party rights
  • Automate abuse attempts, improper scraping, or attacks
  • Use the service to build a competing product with substantial data reproduction

6. API Keys and Security

You are responsible for safeguarding your API keys. Activities carried out with keys linked to your account are your responsibility. If you suspect compromise, revoke the key immediately and generate a new one.

7. Plans, Billing, and Plan Changes

The service offers free and paid plans, with distinct limits and features. Current prices and limits are those posted on the pricing page and dashboard.

  • Upgrades may result in immediate pro-rata charges, according to payment processor rules
  • Downgrades and other changes may take effect immediately or in the next billing cycle, according to the applicable workflow
  • Paid amounts are non-refundable, except where required by law
  • Applicable taxes may be added according to legislation
  • In annual plans, the request quota is renewed monthly, not at the end of the annual term

8. Cancellation and Reactivation

Subscription cancellation is performed by a user with administrative permission in the organization (owner/admin) and generally takes effect at the end of the current billing period. The subscription can be reactivated before the current period ends, where technically available.

9. Usage Limits and Availability

Feriados API establishes operational limits that vary according to the selected plan:

  • Free Plan: Operates under strict Rate Limits (60 requests per minute), without deducting from a monthly quota. Access is restricted to specific routes designated as public (national, state, and capital holidays).
  • Developer Plan: Includes a monthly quota of 5,000 requests and a Rate Limit of 60 requests per minute applied to all routes. Inland city queries and date verification deduct from the quota; queries to the 27 state capitals do not consume quota.
  • Starter and Professional Plans: Include monthly quotas without a per-minute Rate Limit. Quota consumption occurs exclusively and selectively on high value-added routes (such as inland cities and date verification). Public routes do not deduct from the quota of paying users. Queries for holidays in the 27 state capitals are exempt from quota consumption in any plan.

Upon exceeding the Rate Limit in Free and Developer plans, the API will respond with HTTP error 429 (Too Many Requests). Upon attempting to access a restricted route or exceeding the contracted monthly quota in paid plans, the API will respond with HTTP error 403 (Forbidden) requesting an upgrade.

Availability targets and support levels may vary by plan. Commercial SLA information published on the website represents operational goals and may be updated periodically.

10. Data Accuracy

We use reasonable efforts to keep the database updated, but data is provided "as is". State and municipal holidays depend on current state and municipal legislation, which may be enacted, amended, or repealed at any time by the respective government authorities, and updates to our database may experience a natural delay relative to official publication. You must validate data suitability for your use case prior to making critical decisions.

11. Intellectual Property

The Feriados API service, including the API, documentation, web dashboard, website, code, layouts, trademarks, logos, and the holiday database compiled and organized by Feriados API, are the exclusive property of Feriados API or its licensors and are protected by applicable intellectual property laws. The license granted in section 4 does not transfer any ownership rights in these assets, and copying, reverse engineering, redistribution, or substantial reproduction without prior written consent is strictly prohibited.

12. Privacy and Data Protection

Processing of personal data follows the Privacy Policy, which is incorporated into these Terms for all purposes.

13. Suspension and Termination

We may suspend or terminate access in case of violation of these Terms, abusive use, security risk, default, or legal/regulatory order.

14. Disclaimer of Warranties

The service is provided "as is" and "as available", without warranties of continuous availability, error-free operation, or fitness for a particular purpose.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT DAMAGES, LOST PROFITS, LOSS OF REVENUE, DATA, OR OPPORTUNITIES. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT EFFECTIVELY PAID BY YOU IN THE 12 (TWELVE) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

16. Changes to These Terms

We may update these Terms to reflect legal, technical, or commercial changes. The effective version will be published on this page with a new updated date.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of Curitiba/PR are elected to resolve any disputes arising from these Terms, waiving any other jurisdiction, no matter how privileged.

18. Use of Brand and Logo

By creating an account and registering an organization in Feriados API, you grant Feriados API a non-exclusive, royalty-free, revocable, and limited license to display your company or organization's name and logo on our website, landing page, and promotional materials, exclusively for the purpose of identifying you as a client or user of the service.

  • The display will be conducted respectfully, without suggesting endorsement, sponsorship, or partnership beyond the use of the service
  • You may revoke this authorization at any time by sending a request to contato@feriadosapi.com, and we will remove your brand within 10 (ten) business days
  • The license granted herein does not transfer any intellectual property rights over your brand
